General Terms and Conditions of Sale

These General Terms and Conditions of Sale, hereinafter referred to as the "GTC", govern the contractual relationship between Samma Geneva Sàrl, located at 2-4 Place du Molard, 3rd Floor, 1204 Geneva, Switzerland, and any person booking, purchasing or using the services offered by Samma Geneva Sàrl.

They apply in particular to consultations, individual sessions, personalised programmes, subscriptions, packages, gift cards, workshops, events, retreats, products and services offered by Samma Geneva Sàrl, whether the booking or purchase is made online, by telephone, by email, on-site or by any other means.

Samma Geneva Sàrl offers services in complementary medicine, integrative health, prevention, therapeutic support, wellbeing, health optimisation and longevity.

Services may include in particular:

• acupuncture;
• traditional Chinese medicine;
• lifestyle counselling;
• phytotherapy or natural product recommendations, where applicable;
• manual or body therapies;
• wellbeing and health optimisation technologies;
• workshops, conferences, retreats or events.

The services provided by Samma Geneva Sàrl do not replace a medical diagnosis, medical treatment, emergency care or treatment by a physician. In the event of an acute, serious or unusual symptom, the client must contact a physician or an emergency service.

Any booking, registration, purchase, payment or use of the services of Samma Geneva Sàrl implies acceptance of these GTC.

When making a booking or purchase online, the client may be asked to confirm that they have read and accepted the GTC before validation.

Samma Geneva Sàrl reserves the right to amend these GTC at any time. The applicable version is the one in force at the time of the booking or purchase.

Appointments may be booked online, by telephone, by email, on-site or via any other channel made available by Samma Geneva Sàrl.

The booking becomes final when Samma Geneva Sàrl confirms the appointment or when payment is made, depending on the type of service.

Samma Geneva Sàrl reserves the right to refuse or postpone a session if the client's state of health, contraindications, the client's behaviour or any other reasonable circumstance does not allow the service to be delivered under proper conditions.

Service prices are quoted in Swiss francs, CHF.

Unless otherwise stated, the displayed prices include applicable taxes when due. If Samma Geneva Sàrl is subject to VAT, prices are indicated inclusive of VAT, unless otherwise stated.

Samma Geneva Sàrl reserves the right to modify its prices at any time. The applicable prices are those communicated at the time of booking or purchase.

Any additional fees, special conditions or limitations applicable to certain services are indicated before confirmation of the booking or purchase.

Payment may be made using the methods offered by Samma Geneva Sàrl, including in particular:

• on-site payment;
• credit or debit card;
• bank transfer;
• online payment;
• any other method accepted by Samma Geneva Sàrl.

Depending on the type of service, Samma Geneva Sàrl may request full or partial payment in advance to confirm the booking.

Invoices must be settled within the specified timeframe. In the event of late payment, Samma Geneva Sàrl reserves the right to suspend access to its services until full payment of outstanding amounts.

Unless otherwise stated, any cancellation or modification of an appointment must be made at least 24 hours in advance.

In the event of a late cancellation, late rescheduling, no-show or arrival too late to properly carry out the service, Samma Geneva Sàrl reserves the right to charge the session in full.

This policy is intended to respect the time reserved for the client, as well as the practitioners' time.

For certain programmes, events, retreats or specific services, special cancellation conditions may apply. These conditions are communicated at the time of registration or purchase.

In the event of the client's lateness, the session may be shortened so as not to disrupt subsequent appointments.

The full service remains due, even if the actual duration is reduced due to the client's lateness.

Samma Geneva Sàrl may offer packages, personalised programmes or treatment courses comprising several sessions or services.

The specific conditions of each package or programme, including the number of sessions, the validity period, payment terms, possible rescheduling and any restrictions, are communicated at the time of purchase.

Unless otherwise agreed or in exceptional circumstances accepted by Samma Geneva Sàrl, packages and programmes are neither refundable nor transferable.

Unused sessions at the expiry of the validity period may be forfeited, unless otherwise agreed in writing.

Samma Geneva Sàrl may offer subscriptions or memberships providing access to certain services, credits, benefits or programmes.

The specific conditions of each subscription are communicated before registration, including in particular:

• price;
• duration;
• included services;
• number of credits or sessions;
• booking terms;
• cancellation conditions;
• possible renewal;
• commitment period;
• carryover or expiry of credits.

Subscriptions are personal and non-transferable.

Access to services included in a subscription remains subject to availability at Samma Geneva Sàrl and prior booking.

Gift cards are valid for the services indicated at the time of purchase.

Unless otherwise stated, gift cards are valid for 12 months from their date of issue.

Gift cards are non-refundable, cannot be exchanged for money and cannot be extended except by exceptional agreement from Samma Geneva Sàrl.

In Switzerland, there is no general right of withdrawal automatically applicable to online or distance purchases.

Unless otherwise indicated by Samma Geneva Sàrl or by specific agreement, bookings, packages, subscriptions, gift cards, events and programmes purchased are non-refundable.

Samma Geneva Sàrl may however, at its sole discretion and depending on circumstances, offer a rescheduling, a credit or an alternative solution.

The client undertakes to inform Samma Geneva Sàrl and the practitioner of any important information concerning their state of health, including in particular:

• pregnancy;
• chronic illness;
• ongoing medical treatment;
• medication use;
• allergies;
• medical history;
• recent surgery;
• implants or medical devices;
• cardiovascular disorders;
• neurological disorders;
• psychiatric disorders;
• known contraindications;
• malaise or recent change in health status.

The client remains responsible for consulting a physician when their situation requires it.

Samma Geneva Sàrl cannot be held liable for consequences resulting from incomplete, inaccurate or undisclosed information provided by the client.

Certain services may be recognised by certain complementary insurance providers, depending on the practitioner, the method, the insurance and the client's contract.

Samma Geneva Sàrl does not guarantee any reimbursement by insurance providers.

It is the client's responsibility to verify directly with their complementary insurance provider the reimbursement conditions before the start of services.

Where applicable, Samma Geneva Sàrl may provide the necessary supporting documents or invoices, in particular in accordance with Tarif 590.

Samma Geneva Sàrl may offer or recommend certain products, supplements, plants, formulas or items related to wellbeing and health.

These recommendations are given within the framework of the support offered and do not replace medical advice, particularly in the case of illness, pregnancy, breastfeeding, medication use or a specific condition.

The client is responsible for reporting any known allergy, treatment or contraindication before using a product or supplement.

The conditions applicable to workshops, conferences, retreats or events may vary depending on the format, location, duration and partners involved.

Specific terms, including price, programme, cancellation conditions, accommodation, transport, meals, insurance, liability and refund, are specified at the time of registration.

Samma Geneva Sàrl reserves the right to modify the programme, schedule, facilitator or venue of an event when necessary, while endeavouring to offer an equivalent solution.

Samma Geneva Sàrl is a space dedicated to health, care, calm and respect.

The client undertakes to behave respectfully towards the practitioners, staff, other clients and the premises.

Samma Geneva Sàrl reserves the right to refuse access or to interrupt a service in the event of inappropriate, disrespectful, aggressive, dangerous or disruptive behaviour.

In such cases, the service may remain due.

Samma Geneva Sàrl undertakes to provide its services with professionalism, diligence and care.

However, the results of the services may vary from person to person and cannot be guaranteed.

Sammā does not promise any specific result, cure, medical improvement or particular performance.

To the extent permitted by Swiss law, Samma Geneva Sàrl shall not be held liable for indirect damage, economic loss, loss of opportunity or consequences resulting from improper use of services, incomplete information provided by the client or failure to follow the recommendations given.

The liability of Samma Geneva Sàrl in the event of gross negligence or wilful misconduct remains reserved in accordance with applicable law.

Samma Geneva Sàrl processes personal and sensitive data in accordance with its Privacy Policy, available on its website or upon request.

By using the services of Samma Geneva Sàrl, the client acknowledges that certain personal data, including health-related data, may be necessary for the proper performance of the services.

All content created or made available by Samma Geneva Sàrl, including but not limited to texts, images, materials, programmes, methods, documents, videos, audios, logos, trademarks, names, concepts and graphic elements, is protected by intellectual property rights.

They may not be copied, reproduced, distributed, sold, modified or used without the prior written consent of Samma Geneva Sàrl.

Samma Geneva Sàrl cannot be held liable for any delay, cancellation or inability to perform a service in the event of circumstances beyond its control, including but not limited to illness, accident, technical failure, fire, water damage, natural disaster, administrative decision, pandemic, strike, unavailability of a practitioner or any other case of force majeure.

Where possible, Samma Geneva Sàrl will offer a rescheduling or an alternative solution.

If any provision of these GTC were to be deemed null, invalid or unenforceable, the remaining provisions shall remain fully valid.

The provision in question shall be replaced by a valid provision that comes as close as possible to the original economic and legal objective.

These GTC are governed by Swiss law.

Subject to mandatory jurisdictions provided for under Swiss law, any dispute relating to these GTC or to the services of Samma Geneva Sàrl falls under the jurisdiction of the courts of the Canton of Geneva.
